1. Introduction
These Terms and Conditions (“Terms”) govern the use of coaching, mentoring and consulting services provided by Dr Achilleas Hadjikyriacou (“Coach”) to all clients (“Client”) of AchillesWay (i.e. natural persons, legal entities, companies, and organisations). By engaging in any of the aforementioned services with the Coach, the Client agrees to these Terms.
2. Scope of Services
The Coach agrees to provide the Client with services related to personal and/or professional growth as agreed upon by both parties. The Client acknowledges that coaching/mentoring/consulting is not a substitute for medical or psychological treatment. The Client understands that the Coach is not a licensed therapist, counsellor or healthcare professional and their services do not replace the care specialised professionals. The Coach agrees to provide guidance, support, and advice to the Client regarding specific area(s) of interest to the Client.
3. Confidentiality
The Coach agrees to keep all information shared by the Client during their sessions confidential, except as required by law or in the event that the Client poses a danger to themselves or others. The Client also agrees to maintain the confidentiality of all information shared during their sessions with the Coach.
4. Intellectual Property
Any intellectual property developed by the Client during the professional relationship with the Coach will be the property of the Client. The Coach will not claim any rights to the aforementioned intellectual property. Any educational or other material created and/or used by the Coach to support their services are intellectual property of the Coach which the Client is not allowed to share, use or edit without the consent of the Coach.
5. Duration
The Coach-Client relationship will last for a period of time agreed upon by both parties. This period may be extended or reduced by mutual agreement.
6. Communication
The Coach and the Client will communicate regularly via in-person meetings, phone calls, video chats, or email, as agreed upon by both parties.
7. Payment
The Client agrees to pay the Coach the agreed-upon fee for providing coaching/mentoring/consulting services. Payment is due prior to the commencement of each coaching session, unless otherwise agreed upon by both parties. All fees are non-refundable.
8. Cancellation Policy
The Client may cancel or reschedule a coaching/mentoring/consulting session with at least 24 hours’ notice without penalty. Cancellations or rescheduling with less than 24 hours’ notice will result in the forfeit of the coaching session fee.
9. Termination
Either party may terminate their Agreement upon 7 days written notice. In the event of termination, the Client will remain responsible for any fees owed for coaching services provided up to the date of termination. If the Client terminates this Agreement before the completion of the coaching services, no refund will be issued for any fees paid.
10. Limitation of Liability
The Client acknowledges that the success of the coaching/mentoring/consulting relationship depends on the Client’s commitment and effort, and that the Coach is not responsible for the Client’s success or failure. The Client also acknowledges that the Coach is not liable for any damages or losses resulting from the Client’s participation in these services. The Coach will provide guidance and advice to the best of their abilities, but they do not guarantee any particular outcomes or results for the Client.
11. Governing Law
These Terms and any dispute arising from the provision of coaching services shall be governed by the English Law. The Courts of England and Wales will have exclusive jurisdiction to settle any disputes which arise out of the agreement.
12. Entire Agreement
These Terms constitute the entire agreement between the parties and supersedes all prior agreements and understandings, whether written or oral, relating to the services to be provided under this Agreement.
13. Acknowledgment
The Client acknowledges that they have read and understand these Terms, and that they agree to be bound by them. The Client also acknowledges that they have had the opportunity to ask questions and seek expert/legal advice prior to engaging in services with the Coach.
Legal Disclaimer
Coaching, Mentoring and Consulting as mentioned in AchillesWay – and across all platforms, resources and material related to it – are services which provide guidance and support to individuals, legal entities, companies and organisations (“Client”) seeking to improve their personal and professional development. The information provided by Dr Achilleas Hadjikyriacou (“Coach”) is intended to help clients to discover and achieve their goals, but it is not intended to replace any professional expert advice (e.g. legal, financial, psychological, medical). The Coach is not responsible for any decisions made by the Client based on the information provided in the course of their professional relationship.
The Coach does not diagnose, treat, or provide therapy for mental health issues or physical illnesses and the Client understands that the services provided by the Coach is not therapy or counseling and that the Coach is not a licensed therapist or counsellor.
The aforementioned services are provided on an “as-is” basis, and the Coach makes no representations or warranties of any kind, express or implied, with respect to the services provided. The Coach is not responsible for any damages, including but not limited to, direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of their services. The ultimate success or failure of the coaching/mentoring/consulting process will be the result of the Client’s own efforts, particular situation, and innumerable other circumstances beyond the Coach knowledge and control.
While the Coach can provide valuable insights and advice, the Client is ultimately responsible for their own decisions and actions. The Client assumes full responsibility for all decisions made during and after the coach/mentoring/consulting process and agrees to hold the coach harmless for any and all claims, liabilities, damages, and expenses arising out of or in connection with the aforementioned services.
The information provided by the Coach is based on their experience and knowledge, and may not be applicable to every situation. The Coach makes no guarantees or warranties regarding the accuracy, completeness, or reliability of the information provided during the provision of their services. The Coach is not liable for any damages or losses that may arise from the use or reliance on the information provided during their professional relationship with the Client.
The coaching/mentoring/consulting relationship is confidential, and the Coach will not disclose any information provided by the Client without their consent, except as required by law. The Coach and the Client are expected to maintain a professional and respectful relationship.
The Coach retains the right to terminate the coaching relationship at any time if the Client is not fulfilling their obligations, is not benefiting from their services, or if the coach determines that the Coach-Client relationship is not in the best interest of either party.
This legal disclaimer applies to all coaching services provided by the Coach, regardless of the platform or method of delivery.
By agreeing to receive the services of the Coach, the Client acknowledges and agrees to the terms of this disclaimer and to be bound by its Terms and Conditions.
